Parliament's monsoon session ends, triple divorce bill not present in Rajya Sabha

Delhi,10,August,2018

Because it was not agreed between the government and the opposition on the three divorced legislation, it was not presented in the Rajya Sabha today for discussion and this bill was again hanged. Today was the last day of the monsoon session of Parliament and the government wanted to introduce this bill in the House today with some amendments. The bill was also included in today's work list of the house. Chairman M Venkaiah Naidu informed the members during the non-official work in the House that the bill will not be offered for discussion today due to the agreement between the government and the opposition.

For the protection of the rights of married women of the Muslim community, the Muslim woman (marriage rights protection) Bill 2017 was passed by the Lok Sabha and it was introduced in the Rajya Sabha in January, but considering the Opposition's objections, the government discussed it and Did not move forward to pass. The ruling National Democratic Alliance does not have a majority in the Rajya Sabha, so support of the opposition is necessary for passing the bill. Considering the Opposition's objections, the Cabinet had approved three amendments in this bill on Thursday and the government wanted it to be held today for discussion and passage in the Rajya Sabha.

What are three changes

1)Now only the victim or relative can file FIR.

2) There is a provision for withdrawal of cases when the agreement is reached.

3) The bail can be given to the accused only by the magistrate. Police can not get bail.

Thirty years ago, the Rajiv Gandhi government had overturned the Supreme Court's decision to allow Muslim women to pay their respects to politics of appeasement. On April 23, 1985, the Supreme Court had ruled in favor of Shah Bano, ordering that Section 125 of the IPC entitles the divorcee woman to her husband's allowance, applies to Muslim women too. Even today the position of Muslim women is exactly what was thirty years ago. The only difference is that before that Shahbano was now Saira Bano. Saira Banu, who lived in Kashipur, Uttaranchal, filed an appeal in the Supreme Court challenging the constitutionality of triple divorce and marriage of Halaha.

BJP President Amit Shah has convened a meeting in the office of Parliamentary Affairs Minister Ananth Kumar in a strategy on three divorced bills, in which Shah, besides Ananth Kumar, Rajnath Singh, Law Minister Ravi Shankar Prasad, Mukhtar Abbas Naqvi, Vijay Goel, Arjun Meghwal are present. .

October 10, 2015: Shayara Bano has been divorced from her husband's letter.

February 23, 2016: Shayra Bano files a petition in the Supreme Court for a complete ban on the three divorces.

August 22, 2017: Supreme Court declares Triple Divorce Bill declaring as unnatural.

On the occasion of Independence Day last year, Prime Minister Narendra Modi addressing the country from the Red Fort said that the entire India stands with the Muslim mothers and sisters fighting against the three divorces. On the one hand, Muslim women are happy with the formation of Triple Divorce law, while the Muslim Board is opposing it. Now to see whether the opposition will stand with Muslim women or not?
